Your use and access of services provided by us constitutes that you are accepting to bind by this agreement. This agreement constitutes a contract between you and www.turnmile.com (herein referred as ‘we’ or ‘us’). This agreement lay down certain terms and conditions of use that governs the access or use of this website, contents, products, policies and services provided by us www.turnmile.com.

Turnmile Automotive Technologies may amend the terms and conditions of this agreement time and again. Eligibility to Use

  • Website can be used by or service can be available only to the person – who has attained the age of 18 years; who is competent to enter into a contract as per the provisions of the Indian Contract Act, 1872 and will be abide by the contract.
  • If you are entering into this agreement on behalf of a company or any organization, you warrant that you are representing such an entity with the authority to act on their behalf and to bind that an entity to this agreement.
  • Subject to terms and conditions of this agreement we grant you limited access to the website and your account on this website is non transferable, you shall not have more than one active account, you are prohibited from using the account of any other person to avail the services, any other rights as are not granted expressly are reserved by us.

The Services

  • Technicians provides services as Independent contractor: Website is working as platform that assist the users to access a network of independent third party service providers and arrange for the vehicle inspection, servicing, repair, custom modifications, replacement etc. services. A technician provides services to you as an independent contractor and is not an employee, agent, partner of Turnmile Automotive Technologies for any purpose. You acknowledge that we do not supervise, control and direct work of the technician and also the manner of performance of the same.
  • We have mentioned authentic information of services providers as obtain from them, www.turnmile.com cannot guarantee the accuracy and truthfulness of such information and if there is any hindrance from the service provider www.turnmile.com will not be liable for it.
  • You acknowledge that we have the right to modify or discontinue any service at any time without prior notice.
  • While booking any service, it is mandatory that every vehicle should have valid insurance policy of all parties. Pick up drop up facility that service providers give to users through www.turnmile.com is the user’s and service center responsibility and you acknowledge that in case of any accident resulted in any damage to the vehicle www.turnmile.com will not be held liable for the same. In case vehicle is to be kept at service centre of service provider, the service provider will be responsible for the security of the vehicle and under any circumstance we will not have any responsibility to user.
  • All the services, contents and all rights herein provided shall remain our property. These terms, conditions and use of the services do no grant any rights in related to these services to you. All the contents are our property, protected by and subject to Copyright law.(Content point is here)

User Account and its Security

  • You can avail the Services through this website only if you provide certain information required to create the account such as Login ID and password including valid e-mail ID and account information etc.
  • You can avail services only through registered account and it is your responsibility to maintain the confidentiality of the information of your account and responsible for all the activities that happen under your account. If you suspect any unauthorized use of your account you should immediately notify the same to us. www.turnmile.com will not responsible for any loss or damage occurred due to non compliance with these instructions.
  • You will be held liable for any loss to us www.turnmile.com or to any other user of our website due to non compliance of these instructions by you.
  • You should provide complete and up to date and true information to us in case we find out that the information provided by you is false or inaccurate we reserved the right to terminate your account immediately on such suspicion and decline your future use of this website.
  • We provide restrict access and services to non-registered users.

Cancellation of Booking

  • If you have booked any service and you find any error in service booked and desire to cancel the same. You should immediately communicate about the said cancellation by e-mail or as per the contact details provided herein this website.
  • If you want to cancelled the booked service than you should cancel the service before 3 hrs of your pickup time scheduled/ schedule mechanic time to your doorstep and schedule at workshop. Cancellation of the service after that will be charge as as per kind of services you have booked. We reserved the right to modify or amend out cancellation policy any time without prior notice of the same.

Termination of Agreement

  • Termination by www.turnmile.com: We may terminate this agreement or terminate or suspend your account any time on any ground or without any ground with prior notice to you. After such termination or suspension you are prohibited from creating new account on this website. We reserved the right to take any legal actions apart from such termination or suspension of your account. Upon such termination of your account you will not have any ownership on that account.
  • Termination by you: You may terminate this agreement permanently by stop using the services except there is no outstanding service ordered by you in your account. If you try to terminate this agreement despite having outstanding pending service in your account, this agreement shall not be terminate until such services have been completed or cancelled as permitted by terms and conditions provided herein.

Intellectual Property Rights

Service and contents of the website including but not limited to graphics, icon, pictures, text, sounds, music and any other are owned by www.turnmile.com and protected under Copyrights, patent and trademark laws. You are not permitted to use in the form of copy, reproduction, redistribution etc. of whole of the work or any portion of it and it is prohibited without any prior approval from www.turnmile.com.

Payment

  • We reserved the right to modify or update charges for any service or all of the services at any time at our sole discretion without prior notice thereof.
  • You acknowledge that use of the services provided by us results in the payment of charges for the same. Charges may include the applicable taxes. While scheduling any service we will record your preference of the payment method and you also acknowledge of not making any other alternative method of payment with service provider who performed the assigned work.
  • We will use reasonable efforts to ensure security of all credit/debit cards and all other personal information, we expressly disclaim any liability for any damage or loss resulted due to leak of any information to any third party.
  • If service provider adds additional services on prescribed packages as per the needs of your vehicle, you authorize the payment of the said additional services by updated charges. Please read our packages carefully because few things included in our package need to be pay at service center (or to mechanic) at the time of service due to price variations from vehicle to vehicle and company to company.
  • If service provider determines that your vehicle needs other services than you specified or the service provider unable to perform that work, you may be charged separate diagnosis fee.
  • In case of modifications if your requirements is unique and parts to be finalized. You have to pay booking amount first to confirm your order and then our creators makes research on your orders and communicate you through a conference call to make final requirements decision. After this process you have to pay at least 40% of total amount (if order exceeds 50,000) and rest of money will be collected after completion of order/at time of delivery.
    if vehicle of your requirement available at our end then you have to pay only a initial amount of 20% in advance and rest will be collected during dispatch/delivery.
  • When you avail any payment method as per our terms and conditions, we are not liable for any loss or damage of whatsoever nature due to decline of payment on the ground of:
    • Lack of authorization for any transaction.
    • Exceeding transaction limit as per your bank policy.
    • Decline of transaction on any other ground.

Third Party Content

Through our website , client has a ability to use any content or access provided by third parties. The Turnmile Automotive Technologies cannot guarantee that such third party content will be free of material you may find objectionable or otherwise. The Company disclaims any liability or responsibility related to access or use of any third party content.

Roadside Assistance Plans - Terms and Conditions (For Car RSA packages named Class -SGA)

General Terms & Conditions for SGA Roadside packages -
A.1 Financial SGA Cover: Membership Fees must have been paid to us prior to the time of service. If immediate assistance is required, you will be required to pay a Membership fee at the time service is requested. The Member’s card or the Membership Services are not transferable to any other person.
A.2 SGA Delay Period: Any Road Assistance provided to a Member within the Waiting Period will incur a Service Fee.
A.3 Response Time: SGA will be provided as soon as Possible, but response time is not guaranteed and may vary, depending on the location of the Vehicle and demand for Road Assist Services.
A.4 Identification: You must present your membership card and Suitable Identification to the SGA Patrol or SGA Contactor on arrival, otherwise service may be refused or a Service Fee may be payable at the time of service.
A.5 Remaining with the Vehicle: You must be present with the Vehicle or at a pre-determined meeting point when an SGA Contactor or SGA Patrol arrives. Incorrect or incomplete information about your location may result in delay. If you are not available when the SGA Contactor or SGA Patrol arrives, they will wait a short period only before proceeding to the next job. Future call outs for the same Breakdown will be considered an additional separate call out. SGA accepts no responsibility or liability for damage, loss or theft to your Vehicle or its contents if you leave the Vehicle unattended at any time.
A.6 Vehicle under Repair: SG does not include maintenance repairs. SG is not provided to Vehicles already under repair or at a repair workshop. SG will not be provided to Un-roadworthy Vehicles or Unregistered Vehicles.
A.7 Non-Guaranteed Service Areas: Where service is unavailable, we will help in locating alternative assistance. The Member may be required to pay the Service Provider directly and apply to SGA for reimbursement of the allowance applicable to the level of cover of the Member’s SGA Package.
A.8 Un-constructed Surfaces and non-Trafficable Roads: Breakdowns which occur on Un-constructed Surfaces or non-Trafficable Roads will be attended at the discretion of the SGA or SGA Contactors, with any excess cost payable by the Member at the time of service.
A.9 Bogged Vehicles: Vehicles bogged on an Un-constructed Surface or non-Trafficable Road will be attended at the discretion of the SGA. The time spent in recovery of bogged Vehicles and/or equipment used in such a recovery is payable by the Member to the SGA or the SGA Contactor at the time of service. The cost of travelling to the Vehicle is covered by the SGA Package to the extent of the applicable distance limits (Municipal Limits of the Covered City). The Member is responsible for paying any excess cost at the time of service. Service does not extend to a Vehicle that has been damaged as the result of being bogged.
A.10 Tyres: Where the Vehicle requires a spare tyre to be fitted, SGA will only fit a safe and suitable roadworthy tyre. If suitable tyres are not available, or where the surrounding conditions make it unsafe to fit a tyre at the Breakdown Location, the Vehicle will be Towed (up to 10km) to a tyre repair workshop or other location. Wheel changing is limited to Vehicles less than two and a half (2.5) tones as loaded. Any special equipment or specialized Service Provider that may be required will be at the Member’s expense. Service does not extend to tyre repairs.
A.11 Temporary Repairs: SGA is provided to mobilize a Vehicle. It is not a substitute for regular maintenance or permanent repairs. Whilst SGA will exercise all due Club and skill in providing SGA , SGA accepts no liability for any loss or damage (including consequential loss or damage) suffered by you as a result of temporary repairs to your Vehicle.
A.12 Parts and Supplies: The cost of all parts used for repairs and any supplies such as fuel, lubricants, brake fluid, etc. provided is payable by you at the time of service.
A.13 Excess Travelling Distance and Towing: All Excess Kilometres travelled by the SGA Patrol or an SGA Contactor must be paid in cash only by the Member to the SGA Patrol or the SGA Contactor at the time of service.
A.14 Subsequent Country Repairs: The cost of subsequent repairs undertaken by an SGA Contactor or Service Provider at the SGA Contactor’s or Service Provider’s workshop is payable by You to the SGA Contactor or Service Provider at the time of service. Where the SGA Contactor or Service Provider is unable to effect repairs, additional Towing to another repairer and any further repairs are at your cost.
A.15 Special Towing Equipment: If any Special Towing Equipment is required an excess charge may be applied, payable by the Member at the time of service.
A.16 Rallies, Races: SGA does not cover Vehicles which are in organized events such as rallies or Racing.
A.17 Reimbursements: If a Member is assisted by a Service Provider and is required to pay for the service, the Member may apply in writing with receipts to SGA within three months for reimbursement of the appropriate SGA allowance. Reimbursements are not made if the nearest SGA Contactor was available or where the Member did not contact the SGA before utilizing the Service Provider. Reimbursements will be paid at the applicable rates at time of breakdown. Reimbursements will be paid at the applicable SGA rates at the time of breakdown.
A.18 Benefits: All SG service monetary benefits, limits and associated charges include Taxes.
A.19 Pan India wide: SG benefits apply in India only.
A.20 Limits of Use of Services: SGA’s Fair Call Policy (detailed below) applies to Members with SGA.
A.21 Disciplinary Action: A Member is subject to the disciplinary procedures as set out in the Rules and By-Laws of the SGA and the provision of services to a Member may be withheld from the Member if disciplinary proceedings are brought against the Member. If the Member is guilty of conduct not acceptable to the SGA, unbecoming of a Member or Prejudicial to the interests of the SGA or any of the SGA’s related entities, the Member may be suspended or expelled from the SGA and the SGA shall not be required to provide services to that Member during the period of suspension or when the Member is expelled.
A.22. Lockouts: SGA accepts no liability for any loss or damage (including consequential loss or damage) suffered by you as a result of an attempt to open your Vehicle.
A.23 Tow Trucks – Transport of Children 7 years and under: Up to 4 years of age: Under Road Traffic Code MVA 1988 the SGA is unable to transport any children up to the age of four (4) in a tow truck as there are no anchor points installed in commercial vehicles that allow for the fitting of approved child restraints. Alternative transport will be required in all instances of children aged up to four (4). Ages 4 to 7: In instances where a child is aged between four (4) and seven (7), and the member has a child booster seat available for placing in the tow truck, then it will be acceptable for the child to travel in the tow truck. If however, the member does not have a booster seat available we will be unable to transport the child and alternative transport will be required.
A.24 General Limitations: To the extent permitted by law, SGA will not be liable to any person for any indirect, special or consequential loss or damage arising in connection with SGA whether in contract, (including negligence), statute or otherwise. For the avoidance of doubt, no clause in this Assist box Guide, including this clause, is intended to limit the rights any person has under the Competition and Consumer Act 1986.
A.25 General Limitations:
Turnmile will not be liable for any failure or delay in providing SG Assistance, where the failure or delay arises directly or indirectly out of causes beyond Turnmile’s reasonable control including where the SGAis not reasonably available.
Safety policy please notes the following Road Assistance Safety Policy of the SGA recognizes that the safety and health of the SGA, Members and the public are paramount when mobilizing a Vehicle.
Where SGA suspects that the driver of a Vehicle is unfit or incapable of driving that Vehicle in a safe manner by reason of being under the influence of drugs, alcohol, or any other factor, the SGA may decide, at its sole discretion, to; Leave the Vehicle immobile, or mobilize the Vehicle (where that Vehicle is capable of being mobilized). Where the decision is made to mobilize the Vehicle (and thus avoid any immediate safety and health risk) the incident will be reported by the SGA to the police. Road Assistance will not be provided when in the reasonable opinion of SGA it is deemed unsafe for an SGA Patrol or SGA Contactor to attempt, or continue attempting, to mobilize a Vehicle at a Breakdown. Fair-Call policy Excessive use of SGA Road Assistance is managed through Fair-Call. The Fair-Call policy is a case management approach to reduce excessive use of SGA. The case management approach allows the SGA to manage Members who make excessive calls per Vehicle per Membership Year.
If a Member fails to abide by the Fair Call Policy, SGA may notify the Member that continued use of the SGA Road Assistance services may lead to the Member being charged a Service Fee for further services.
Refund Policy
The SGA has a no refund policy on joining fees and annual Membership Fees. Pro-rata refunds are not available. However, if you wish to cancel Your Membership Services because you are moving interstate, you will be able to transfer Your Membership Services to the SGA if it is available in the City List moving State. Just contact SGA when you arrive. Elsewhere3 in South India If Your Vehicle is disabled in the capital city of another South India State or Territory, free Road Assistance may only be provided up to the limit of that State’s or Territory’s standard membership. Any additional services, including towing disabled Vehicle at the time of the Breakdown will need to be paid for by you to the Service Provider. South India has the largest state in India. We advise you to take appropriate precautions when travelling in remote, regional, rural and Country Areas. In remote Country Areas, delays may occur, subject to local conditions. Road Assist Club provides you peace of mind for:
(a) T ravel by a Service Provider on a sealed road trafficable by a Four wheel drive vehicle from the nearest SGA Agent or Service Provider’s registered business address to the Breakdown within the service limits, with one trip per Breakdown.
(b) Labour at the Breakdown for up to 30 minutes duration. Please note that you are under no obligation to have any workshop repairs carried out by the SGA Agent or Service Provider. There is no guarantee that repairs will be immediate, or the necessary parts will be in stock at the SGA Agent’s or Service Provider’s registered business address.
(c) Towing assistance in Country Areas cannot always be guaranteed as it is subject to local conditions, including the availability of Towing equipment.
(d) Travel on any Un-constructed Surface or non-Trafficable Roads to provide Road Assistance will incur excess fees payable by you at the time of the Breakdown. (The provision of services in this situation is at the sole discretion of SGA).Road Assist Club Service Fee a Service Fee may be charged for any Vehicle that has suffered a Breakdown where the Vehicle has not been nominated by a Member or on a non-financial membership. Non-members that join SGA and who require Road Assistance for a Breakdown may also be charged a Service Fee (joining SGA while in a Breakdown will incur a joining fee in addition to the Membership Fee).SGA Road Assistance Service providers Facility Index 24 hours Road Assistance. ROADSIDE ASSISTANCE PROGRAM TERMS AND CONDITIONS –AGA MARKED (AGA OFFRINGS) PACKAGES

For 2 Wheeler

By using the website and/or submitting your details including contact details, vehicle details and other personal details, to buy the Roadside Assistance Plan you authorize AGA/TURNMILE and its group companies to "Contact" you even if you are registered with National Do Not Call (NDNC), Do Not Disturb (DND) or Do Not Call (DNC) databases.

The "Contact" may happen over phone, SMS, email or any other medium of communication. The communication could be for the purpose of verifying your details, offering support and information on suitable products, assisting in closing a sale or sharing related information, providing you with the requested service, renewal reminders or promotional messages related to plan(s) or service(s) bought by you.

Membership Duration: As per selected plan
Coverage Area: As per selected plan

All entitlements are available after 48 hours: Your RSA Plan buying request will be verified first as per your location and vehicle. All benefits under roadside assistance program become available 48 hours after you have purchased the subscription. If Roadside Assistance services are requested before 48 hours of joining the membership, the services will be provided on chargeable basis.

Transfer of Membership: Roadside Assistance Membership is for the registered vehicle only and is non-transferable, in case the vehicle ownership changes the new owner can avail the Roadside Assistance services until the expiration of the membership.

Green Tax & Other Charges: In case the vehicle is being towed from one state to another or from one city to another, any local tax or toll tax, like green tax in Delhi-NCR and etc. has to borne by customer.

Un-located or Unattended Vehicle: In case of a breakdown, you must be able to provide us with the correct location of your vehicle. In correct or incomplete information may cause a delay in provision of our services. You or an authorized representative must be present with the vehicle at the agreed meeting place when we arrive. If the vehicle is not attended when we arrive, services cannot be provided.

Vehicle is off road: In case the vehicle is not on gazette, bitumen road and if there is a need to arrange special equipment (any equipment other than standard towing equipment), the charges of such equipment are not part of the roadside assistance program. The charges for arrangements of special equipment are to be borne by you directly. Please note that extraction of vehicle using special equipment might result in certain consequential damages to the vehicle. Such damages shall be your sole responsibility and we shall not be held liable for such damages. You must give a written or verbal consent before the process of extraction is initiated by us.

Repair and Labour charges: The roadside assistance program does not include the labor charges, parts replacement costs associated with repair of the vehicle.

Excessive Usage: If we consider in our reasonable opinion that you have received (and continue to request) roadside assistance benefits on an excessive number of occasions in a subscription year, we may refuse to provide further roadside assistance free of charge. We will offer an alternative service at your own expense such battery jump-start or towing services for roadside assistance payable at the time service is requested.

Contacting the call center is mandatory: The Roadside Assistance is available only if the above mentioned numbers are contacted. In case you opt for your own vehicle assistance or towing services without informing the roadside assistance call center the cost for the same shall be borne by you.

Non-Covered Events: Roadside Assistance is established to help in event that leads to stoppage / immobilization of your vehicle. As a result, this program will not cover any of the following events that you may encounter while driving your vehicle.

Faulty fuel gauge: Speedometer not working; Air-conditioning is not working; When the passenger door(s) cannot be opened and there are no passengers in the vehicle; Boot cannot be opened; The front and/or rear demisters are not functioning; Horn is not functioning. If the horn is sounding continuously, the Assistance Services will be provided; Damaged door mirrors; When the rear view mirror is damaged but it does not obstruct the driver's vision; Damaged or faulty fuel cap but vehicle has not run out of petrol and there is enough fuel in the tank to enable the vehicle to reach the nearest authorized service station. When the sun roof cannot be opened; When the sunroof cannot be closed but weather conditions are fair and the vehicle is not exposed to any security risk; When windows cannot be opened. When windows cannot be closed but weather conditions are fair and the vehicle is not exposed to any security risk. Seat adjuster is faulty but the vehicle can be safely driven; When passenger seat belts are faulty but there are no passengers in the vehicle. Faulty security system unless the vehicle is immobilized or unless the alarm is sounding continuously. Transmission stuck in sports/winter mode. When the ABS lights are illuminated; Air bag warning lights are illuminated; Traction control lights are illuminated; Other non-safety related lights/service warnings are illuminated; When your Vehicle runs out of windscreen wiper fluid; Front windscreen wipers faulty but weather conditions are fair; Rear windscreen wiper faulty; Vehicle pick-up and drop for routine maintenance is not included.

Special Exclusions: The following scenarios are special exclusions under the Roadside Assistance Program, and therefore we will not be responsible for any assistance costs as a result of any of the following:

  • Vehicle is involved in motor racing, rallies, speed or duration tests, practice runs or operated outside official roads
  • Assistance is required as a result of wars, riots, uprising, mass political demonstrations, pillage, strike, use for military purposes or acts of terrorism, earthquake damage, freak weather conditions, atmospheric phenomena, nuclear transformation phenomena or radiation caused by artificial acceleration of atomic particles
  • Breakdown is caused by deliberate damage, vandalism or participation in a criminal act or offence
  • The immobilization is resulting from damage caused by intervention of the police or other authorities
  • Any damage resulting from the use of the vehicle against the recommendations of the owner manual
  • Any consequential costs and/or damage to property as a result of a breakdown

Adverse Weather: On occasion of adverse weather conditions such as floods, heavy rain, thunder / lightening or other external factors may affect our ability to provide services and it may become physically impossible to assist you until the weather improves. During such times, our main priority will be to ensure that you and your passengers are taken to a place of safety; the recovery of your vehicle may not be possible until weather conditions permit.

External Factors: We will take every effort to reach you once you make the call however the response time may vary depending on, among other things, the breakdown location of the vehicle and the general demand for roadside assistance at the time of your request is received.

Locked Keys: Whilst we will always endeavor to provide assistance by the most efficient method, modern security systems sometimes make it extremely difficult for us to gain entry to your vehicle at the roadside should the spare keys not be available. If a forced emergency entry is required, you will be asked to sign a declaration stating that you have granted permission for this to take place and confirming that all costs relating to any resulting damages to your vehicle will be your sole responsibility.

Right of Refusal: We shall have the right to refuse any or all benefits under the program, if it is found that you had furnished false information relating to your eligibility or entitlements to the benefits provided under this program.

Disputes: Courts situated within the jurisdiction of New Delhi alone shall have the exclusive jurisdiction to decide all disputes that may arise under this service.

If Roadside Assistance services are requested before 48 hours of joining the membership, the services will be provided on chargeable basis.

Transfer of Membership: Roadside Assistance Membership is for the registered vehicle only and is non-transferable, in case the vehicle ownership changes the new owner can avail the Roadside Assistance services until the expiration of the membership.

Green Tax & Other Charges: In case the vehicle is being towed from one state to another or from one city to another, any local tax or toll tax, like green tax in Delhi-NCR and etc. has to borne by customer.

Un-located or Unattended Vehicle: In case of a breakdown, you must be able to provide us with the correct location of your vehicle. In correct or incomplete information may cause a delay in provision of our services. You or an authorized representative must be present with the vehicle at the agreed meeting place when we arrive. If the vehicle is not attended when we arrive, services cannot be provided.

Vehicle is off road: In case the vehicle is not on gazette, bitumen road and if there is a need to arrange special equipment (any equipment other than standard towing equipment), the charges of such equipment are not part of the roadside assistance program. The charges for arrangements of special equipment are to be borne by you directly. Please note that extraction of vehicle using special equipment might result in certain consequential damages to the vehicle. Such damages shall be your sole responsibility and we shall not be held liable for such damages. You must give a written or verbal consent before the process of extraction is initiated by us.

Repair and Labour charges: The roadside assistance program does not include the labor charges, parts replacement costs associated with repair of the vehicle.

Excessive Usage: If we consider in our reasonable opinion that you have received (and continue to request) roadside assistance benefits on an excessive number of occasions in a subscription year, we may refuse to provide further roadside assistance free of charge. We will offer an alternative service at your own expense such battery jump-start or towing services for roadside assistance payable at the time service is requested.

Contacting the call center is mandatory: The Roadside Assistance is available only if the above mentioned numbers are contacted. In case you opt for your own vehicle assistance or towing services without informing the roadside assistance call center the cost for the same shall be borne by you.

Non-Covered Events: Roadside Assistance is established to help in event that leads to stoppage / immobilization of your vehicle. As a result, this program will not cover any of the following events that you may encounter while driving your vehicle.

Faulty fuel gauge: Speedometer not working; Air-conditioning is not working; When the passenger door(s) cannot be opened and there are no passengers in the vehicle; Boot cannot be opened; The front and/or rear demisters are not functioning; Horn is not functioning. If the horn is sounding continuously, the Assistance Services will be provided; Damaged door mirrors; When the rear view mirror is damaged but it does not obstruct the driver's vision; Damaged or faulty fuel cap but vehicle has not run out of petrol and there is enough fuel in the tank to enable the vehicle to reach the nearest authorized service station; When the sun roof cannot be opened; When the sunroof cannot be closed but weather conditions are fair and the vehicle is not exposed to any security risk; When windows cannot be opened; When windows cannot be closed but weather conditions are fair and the vehicle is not exposed to any security risk; Seat adjuster is faulty but the vehicle can be safely driven; When passenger seat belts are faulty but there are no passengers in the vehicle; Faulty security system unless the vehicle is immobilized or unless the alarm is sounding continuously; Transmission stuck in sports/winter mode; When the ABS lights are illuminated; Air bag warning lights are illuminated; Traction control lights are illuminated; Other non-safety related lights/service warnings are illuminated; When your Vehicle runs out of windscreen wiper fluid; Front windscreen wipers faulty but weather conditions are fair; Rear windscreen wiper faulty; Vehicle pick-up and drop for routine maintenance is not included.

Special Exclusions: The following scenarios are special exclusions under the Roadside Assistance Program, and therefore we will not be responsible for any assistance costs as a result of any of the following:

  • Vehicle is involved in motor racing, rallies, speed or duration tests, practice runs or operated outside official roads
  • Assistance is required as a result of wars, riots, uprising, mass political demonstrations, pillage, strike, use for military purposes or acts of terrorism, earthquake damage, freak weather conditions, atmospheric phenomena, nuclear transformation phenomena or radiation caused by artificial acceleration of atomic particles
  • Breakdown is caused by deliberate damage, vandalism or participation in a criminal act or offence
  • The immobilization is resulting from damage caused by intervention of the police or other authorities
  • Any damage resulting from the use of the vehicle against the recommendations of the owner manual
  • Any consequential costs and/or damage to property as a result of a breakdown

Adverse Weather: On occasion of adverse weather conditions such as floods, heavy rain, thunder / lightening or other external factors may affect our ability to provide services and it may become physically impossible to assist you until the weather improves. During such times, our main priority will be to ensure that you and your passengers are taken to a place of safety; the recovery of your vehicle may not be possible until weather conditions permit.

External Factors: We will take every effort to reach you once you make the call however the response time may vary depending on, among other things, the breakdown location of the vehicle and the general demand for roadside assistance at the time of your request is received.
Locked Keys: Whilst we will always endeavor to provide assistance by the most efficient method, modern security systems sometimes make it extremely difficult for us to gain entry to your vehicle at the roadside should the spare keys not be available. If a forced emergency entry is required, you will be asked to sign a declaration stating that you have granted permission for this to take place and confirming that all costs relating to any resulting damages to your vehicle will be your sole responsibility.

Right of Refusal: We shall have the right to refuse any or all benefits under the program, if it is found that you had furnished false information relating to your eligibility or entitlements to the benefits provided under this program.

Disputes: Courts situated within the jurisdiction of New Delhi alone shall have the exclusive jurisdiction to decide all disputes that may arise under this service.

AGA PLANS Cancellation & Refund Policy

This page explains the terms & conditions and procedure applicable in case you would like to surrender/cancel your subscription package, and sets the guidelines for refund of your money.
1.Cooling Period (10 days): AGA allows you to review your subscription details and surrender the subscription plan within the cooling period of 10 days (which commences from the date of customer receiving the Email confirming the purchase of subscription), if you are not satisfied with terms and conditions and/or services offered or policy construct or any other aspect. Cooling period is the time period during which customer can surrender the subscription package and be eligible for the refund of full amount of the subscription package, provided customer has not availed any benefit or service 1 times or more, during this time period.
2.Charges applicable on Cancellation/Surrender requests made beyond the Cooling Period of 10 days, provided customer has not availed any benefit or service 1 times or more under the subscription period, as set out in below table

3.You can also request for cancellation of membership based on a specific case/incident that lead to your dissatisfaction about our service. The incident will be probed and any finding of negligence or service denial from our team will have you eligible for applying for a refund. Any such request for cancellation and refund must be made within seven (7) business days from the time of such an incident. Customers who fail to provide the adequate details pertaining to lapses in providing the services or identifying the actual issues might not be considered for payment for refund.

Decision of AGA pertaining to refund shall be final in all respects.

Scheduling a Service

  • While requesting for an appointment for vehicle service you may be asked to specify certain information i.e. type of service you want, the location where you want that service to be performed, date and time that you would like service to be perform. You are giving consent that it is your accountability to provide suitable location for the service to ensure that service provider has proper access to such place and legally authorize to perform it.
  • When you submit the request for the service you want to get, we may provide you the list of charges/prices for the same as well as the list of the service providers along with their experience of service and also the previous customer’s reviews of their work if any. We reserve the right to modify and add the charges any time prior to billing you.
  • If you have agree with the service provider to modify the service or items in the service or reschedule the service than you must notify the same to us and when to reschedule the service you will do from this platform.
  • You acknowledge that you will provide safe environment to service provider to perform the service in compliance with the law of the land and further acknowledge that you will treat them politely and cooperate with them to perform the services. We do not control the availability of service providers as they are third party contractor and you acknowledge that your selected service provider may not be available at time due to illness or on vacations.
  • Sometimes components made of plastic and rubber are frequently affected by the temperature as well as the age and become delicate and if due to this reason while disassembling or handling they collapse. We will not be liable for such collapse of the components. We can only provide you the estimate price for the component in case of replacement.
  • If your vehicle services/modifications finished in specified time frame and you will be informed. Then its your responsibility to collect vehicle on same day or next day otherwise additional charges will be applied as per parking fee on per day basis.
  • If you have select Deal from our service then you have to schedule services included in deal prior to go for actual services.
  • In modifications, firstly we receive order and process for expert advices from our creaters, arrange a conference call between you and our creators and then after 1st half of payment we will proceed for further operations on vehicle by explaining you each and every espect of service with estimated time of final delivery.

Communications

By accepting the term and conditions the user accepts that www.turnmile.com may send alerts regarding services, offers or gifts vouchers etc on your registered mobile number or through an e-mail on your registered e-mail id as provided by you. We are not under any responsibility to authenticate the identity of any person before sending such alert messages. In case of any error in the information provided in alert message, user will immediately informed www.turnmile.com about the error. We will make efforts to rectify the same. We will not be held liable for any loss or damage that may incurred by such alert message service to the user.

User Content

We may permit you from time and again to submit, upload, publish or otherwise make available textual, audio, or visual content and information, including comments and feedback related to the Services, initiation of support requests, and submission of entries for competitions and promotions. Such contents provided by you will remain your property. However, you acknowledge and grant us unrestricted right to use, copy, modify, transmit, published and distribute such contents in any manner without prior notice or your consent and also without making any payment to you for it. You also warrant that such contents are your property and you are the sole owner of it or having all the rights to grant us further license to use such contents. That the user content as permitted herein will not infringe or violate the rights of any third party. You agree that you will not provide such user content which is la, defamatory obscene, unlawful or otherwise offensive. We may review, remove or monitor such user contents without any prior notice to you and we shall not be abiding to do so.

Jurisdiction in case of dispute

This agreement is subject to exclusive jurisdiction of competent Court of law at India only. All the disputes with users, third party or any service related shall be in jurisdiction of Chandigarh only. All the alleged issues/disputes, notices or communications relating to this agreement shall be in writing in English language and shall be sent by email or by post, courier, hand at the registered office only. Or such communication, notices, issues shall be caused to be delivered by e-mail at admin@turnmile.com or turnmileauto@gmail.com.
